One limitation that might make some sense is that the movie only had so long, and the exposition had to come from Tony. So of course he's not going to go into how the compromises were made or even what the real requirements were. The secrecy and speed are pretty much impossible.
Empirically, something like a special class of people created, where your government can decide whether you belong. People in this class can either be drafted or required to avoid any illegal activity, on pain of imprisonment without trial.
So, what could this have been to start with? In a world with more superpowered villains, this would have been a terrorism act pointed at them. In the MCU, it doesn't make much sense: the only superpowered villain is Loki. The Red Skull's been gone since WWII and everyone else I can remember is technologically enhanced.
Could the negotiations have started with granting extra permissions and freedoms to 'heroes', with the compulsory stuff tacked on at the end in response to rising paranoia?
